Terms of Use and End User License Agreement

AscendSX is a simulation and education app that runs on virtual money. No
balance in the app is real money; it cannot be cashed out, withdrawn or transferred, and it
confers no right over any asset. AscendSX is not an exchange, a broker or a
custodian, and it never places a real order on your behalf.
Nothing in the app — price data, rankings, contests, other users' posts or comments included —
is investment advice, financial advice or a recommendation to buy or sell.
Any decision you make in real markets is entirely your own responsibility.
1. Parties and acceptance
This agreement is between [LEGAL ENTITY NAME] ("AscendSX", "we"), which
operates the AscendSX app, and the person using it ("you"). By creating an account or using the
app you accept these terms and the Privacy Policy. If you do not accept
them, do not use the app.
2. License
AscendSX grants you a non-transferable, non-exclusive, revocable license to use
the app for personal, non-commercial purposes on devices you own or control. You may not copy,
rent, sell, reverse-engineer, modify or create derivative works from the app. Accessing the app
with automated tools (bots, scrapers, emulator farms) is prohibited.
3. Your account
- You must be at least 18 years old to create an account.
- The information you provide must be accurate; you may not impersonate anyone or create fake accounts.
- One person, one account. Entering contests with multiple accounts belonging to the same person is prohibited.
- You are responsible for keeping your password confidential and for everything done with your account. Tell us immediately if you suspect unauthorised access.
- You may not sell, rent or transfer your account.
4. Virtual balance and purchases

Virtual balance is digital content used inside the app. It is not money,
electronic money, a crypto asset or a security, and it grants no right over any real asset.
- Virtual balance cannot be cashed out, withdrawn or transferred to another account and has no value outside the app.
- Virtual balance is bought through in-app purchase via the Apple App Store or Google Play. The store takes the payment; your payment details never reach us.

Refunds: refunds for App Store purchases follow Apple's rules and process,
and refunds for Google Play purchases follow Google's. You must take a refund request directly
to the relevant store. Where a store grants a refund, we reserve the right to remove the
corresponding virtual balance from the account.
- No payment is made for any virtual balance remaining when an account is closed.
5. User content
The trades, captions, comments, journal notes and images you post ("your content") belong to
you. By posting them you grant AscendSX a worldwide, royalty-free, transferable and
sublicensable license to use, display and distribute them for the sole purpose of
operating the service. This license ends when you delete the content, except for the time it
remains in technical backups.
You are responsible for your content. You represent that what you post is
lawful and does not infringe anyone else's rights.
6. Prohibited conduct
The following are strictly prohibited:
- Harassment, bullying, threats, insults and personal attacks
- Hate speech; demeaning anyone on the basis of race, ethnicity, religion, gender, sexual orientation, disability or nationality
- Incitement to violence, or content that glorifies or normalises it
- Sexual or obscene content, and any content involving the exploitation of minors
- Publishing someone's personal information without their consent (doxxing)
- Spam, repetitive posting, irrelevant advertising, referral-link flooding

Manipulative financial content: pump-and-dump calls, guaranteed-profit
promises, selling signals, posing as a licensed financial adviser, fabricated result
screenshots
- Fraud, phishing, and sharing malicious links or software
- Impersonating another person, or posing as AscendSX staff or a representative
- Copyright or trademark infringement
- Attempting to influence the app, the rankings or contest results through cheating, multiple accounts or technical exploits
- Attacking, overloading or attempting unauthorised access to the systems
7. Reporting, blocking and moderation
We operate a zero-tolerance policy toward abusive behaviour.

Reporting: every post and every comment has a menu from which you can report
it. You can also write to

Response time: we review every report that reaches us
within 24 hours, remove content that breaks these rules and, where warranted,
suspend or close the account responsible.

Blocking: you can mute a user so their posts and comments no longer appear in
your feed. Muting takes effect immediately.
- Your own content: you can delete your own comment or journal note at any time.

We may remove content and suspend or close accounts without prior notice where we find a
breach of these rules. If you believe a decision was wrong, you can appeal through the support
address.
8. Contests
The rules, duration and prize of each contest are published on that contest's page, and entering
means accepting them. Rankings are calculated automatically from simulation results. Any entrant
found cheating, using multiple accounts or exploiting the system is disqualified and forfeits
the prize. We reserve the right to cancel or postpone a contest where technical or legal
necessity requires it.
9. Market data and interruptions
Prices come from Binance's public market data services and charts from TradingView. This data
belongs to third parties; it may be delayed, incorrect or unavailable. AscendSX gives no
warranty as to its accuracy, timeliness or continuity. We may suspend the service temporarily
for maintenance, updates or technical necessity.
10. Disclaimer and limitation of liability
To the fullest extent permitted by law, the app is provided "as is" and "as
available". AscendSX does not warrant that the app will be uninterrupted or error-free.
AscendSX is not liable for loss of profit, loss of data, loss of business or indirect damages.
In any event our total liability is limited to the amount you paid to the app in the 12 months
before the claim arose. This limit does not apply to liability arising from our wilful
misconduct or gross negligence, or to liability that cannot be limited by law.
You agree to indemnify us against claims brought by third parties as a result of your breach of
these terms.
11. Termination
You may end this agreement at any time by deleting your account (see
Privacy Policy, section 8). We may suspend or close your
account if you breach these terms. When the agreement ends your license ends with it; the
liability, indemnity and dispute clauses survive.
12. Apple App Store specific terms
If you downloaded the app from the Apple App Store, the following also applies:
- This agreement is between you and AscendSX only; Apple is not a party to it. AscendSX alone is responsible for the app and its content.
- Apple has no obligation whatsoever to furnish any maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
- Product liability claims, regulatory and consumer protection claims, and third-party claims that the app infringes intellectual property rights are the responsibility of AscendSX.
- You represent that you are not located in a country subject to a U.S. Government embargo and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of this agreement and have the right to enforce it against you.
13. Changes
We may update these terms. Updates are announced by the date at the top of this page, and for
material changes we also notify you inside the app. Continuing to use the app after a change
means you accept the new terms.
14. Governing law
This agreement is governed by the laws of the Republic of Türkiye, and
[COMPETENT COURTS] have jurisdiction over disputes. If you are a consumer, your
right to bring a claim before the consumer arbitration committees and consumer courts where you
live is unaffected by this clause.
